Terms & Conditions
1.1. "Agency" represents Supremely. The agency is an introduction Agency which means that the Host family or Employer pays a fee after the work offer is being accepted by a Candidate following the introduction by the Agency.
1.2. "Client" represents the Host family or an Employer or third party representing them.
1.3. "Candidate" represents an individual introduced to the Client by the Agency (Au Pair, Nanny or other Private Staff).
2.1. With submitting the Registration Form, the Client or Candidate confirms they agree with the Terms and Conditions.
3.1. The Agency is registered with the Information Commissioner's Office and thus complies with the Data Protection Act 1998. Therefore, the information that the Client or Candidate provide us is secure and will not be shared with anyone who is not directly involved with the process.
4. CLIENT'S RESPONSIBILITIES
4.1. The Client acknowledges that the Agency does not employ the Candidate because it has an introductory role between Clients and Candidates only.
4.2. The Client confirms that they are aware of the type of childcare, their descriptions, and duties either by reading the information on the website or information sent to the Client by the Agency and will follow them.
4.3. The Client confirms that they have provided only true and honest information to the Agency and if any of your circumstances or requirements change, they notify the Agency.
4.4. The Agency introduces the best matching Candidates, but the Client will have the final decision about who to choose.
4.5. The Client and the Candidate will agree on the Candidate’s responsibilities which will be described in a Contract.
4.6. The Client will give a fair payment to the Candidate which will be discussed before the placement starts.
4.7. The Client is responsible for the invitation letter (applicable to Au Pairs) or employment contract (applicable to Employees) between the Client and Candidate which will be provided before the job offer will be made.
4.8. The client who employs a Candidate is responsible for their Tax and National Insurance Contributions (normally not applicable to au pairs).
4.9. It is crucial that the Client informs the Agency if the Candidate has been introduced to them by other parties. The Agency will immediately end the engagement to this candidate. However, if the Client does not mention this to the Agency, the Client will be still eligible for full payment.
4.10. The Client agrees not to introduce in any way the Candidates’ details to any other party, parents or agencies.
4.11. The Client has to give 1 month of notice to the Candidate if they would like to terminate the placement.
4.12. The Client who employs a Candidate has a responsibility to have insurance cover for Employers and Public Liability insurance for domestic workers in place.
4.13. The Client pays the introduction fee to the agency once the work position to the candidate is being offered.
5. AGENCY'S RESPONSIBILITIES
5.1. The Agency provides the services to the client from the date specified in the registration form.
5.2. The Agency takes the time to thoroughly interview the candidates and obtain up-to-date CV, ID proof, references and police check where reasonably possible to consider the suitability of the candidates, however, the final responsibility and final decision of the candidate’s acceptance lies with the client.
5.3. The Agency shall use its reasonable endeavours to introduce candidates who are of sound character, honest and reliable however the agency cannot be responsible for the conduct of a candidate or any inconvenience, damage or loss caused directly or indirectly by a candidate.
6.1. There is no registration fee.
6.2. The prices of the different type of placements are following:
Nanny or Private Staff member: 12% annual gross salary
1-2 months Au Pair: £170
3-5 months Au Pair: £270
6-12 months Au Pair: £399
6.3. The Client must pay the full fee for introduction to Supremely after the Candidate accepts the Client’s work offer and before the Candidate’s arrival. The invoice will be sent via email.
7.1. The Au Pair placement is subject to one free Au Pair replacement candidate based on the same search criteria if the Client sends an acceptable reason for this via email within first month of the Au Pair’s arrival. The introduction fee for an Au Pair is non-refundable.
7.2. The Private Staff placement is subject to a replacement Candidate option based on the same search criteria, unless agreed differently, during first six months of the employment contract. If the Client decide to opt out of a replacement candidate option, a refund can be given accordingly:
Week 1: 90%
Week 2: 80%
Week 3: 70%
Week 4: 60%
Week 5: 50%
Week 6: 40%
Week 7: 20%
Week 8: 10%
7.3. The Agency accepts no liability or will not make a refund if the Client decides not to engage any of the introduced best matching replacement Candidates.
7.4. If the Candidate terminates the au pair work or employment with the Client due the terms in the contract being breached by the Client, the replacement guarantee or refund will be invalidated by the Agency.
8.1. If there was a serious misconduct to a Candidate or Client, they can terminate the placement immediately.
8.2. The Agency shall not be liable or responsible for any loss, damages, delay, inconveniences, death, personal injury whether direct or indirect, suffered or incurred by the Client, Client’s family, servants or Client’s assets as a result of the introduction of a Candidate to the client by the Agency, the engagement of a Client introduced by the Agency or the failure of the Agency to introduce any Candidate to the client.
9.1. If any provision of these Terms of Business is found by any court of competent jurisdiction to be invalid, illegal or unenforceable in whole or in part for any reason such provision shall be ineffective or deemed modified to the extent necessary to conform to applicable law and the legality, validity or enforceability of remainder of the provisions hereof shall not be affected.
10.1. These terms and conditions are subject to the laws of England and Wales.
10.2. The agency has the right to update these terms and conditions.
